The Legitimation Process in Florida 

There are two ways to establish paternity through legitimation in Florida:

  1. Filing form DH-743A. This document affirms that a father and his partner are a) the biological parents of the child, b) the birth record does not list another father, and c) they were unmarried at the time of the child’s birth but are seeking a marriage license.
  2. Getting a marriage license. A father can legitimize his paternity on this license by stating he and his spouse have children together.

In certain cases, the biological mother of a child may contest a father’s legitimation. If this happens, the father will have to appear in court, and a judge could order a genetic paternity test. 

The Legitimation Process in Georgia

The primary method for establishing paternity through legitimation in Georgia is by petitioning for it. A person must file this petition with the state, and it should include requests for visitation rights, child support, and custody. The child’s biological mother may agree to the petition, which would allow it to move forward. Should a mother object, it would prompt a legitimation hearing. 

During this legal process, a judge may order a test to establish genetic paternity. A judge will also consider the extent to which a father has already attempted to support and establish a relationship with the child.
